3. Processing of personal data as well as the nature, purpose, and use thereof
- a) As a rule, we process the following data relating to you:
- Company name
- Title, first name, and surname of the designated contact persons
- Address (if different: billing address)
- A valid email address
- Telephone number (landline and/or mobile)
- Bank details
- Creditreform data
We assign you a customer number in our system.
- b) For what purposes do we process your data (purpose of processing) and on what legal basis?
Below, we inform you for what purposes and on what legal basis we process your data.
- aa) For the performance of contractual obligations and/or the implementation of pre-contractual measures (Art. 6 (1) sentence 1 lit. b) GDPR)
We process your personal data for the performance of contractual obligations and/or the implementation of pre-contractual measures taken at your request, in particular:
- for contract fulfillment;
- for correspondence with you;
- for invoicing;
- for handling warranty claims;
- for handling any liability claims that may exist, as well as for the assertion of any claims against you.
- bb) Based on your consent (Art. 6 (1) sentence 1 lit. a) GDPR)
Insofar as you have granted us consent to process personal data, the respective consent constitutes the legal basis for the processing specified therein.
This applies in particular to:
- the collection and storage of additional personal data;
- promotional communications by telephone, email (e.g. Christmas greetings) or via social media.
You may withdraw your consent at any time with effect for the future. We inform you that the withdrawal of consent shall not affect the lawfulness of processing carried out on the basis of the consent before its withdrawal.
- cc) Based on legitimate interest (Art. 6 (1) sentence 1 lit. f) GDPR)
We may also use your data on the basis of a balancing of interests in order to safeguard our legitimate interests or those of third parties. This is done, for example, for the following purposes:
- maintaining an order history for our future service offerings;
- customer advice and support, and sales;
- obtaining Creditreform reports for creditworthiness assessments;
- general business management and the further development of services and products;
- advertising, market research, and opinion research;
- anonymisation of personal data for the use of such data in machine learning training (AI training).
Our interest in the respective processing arises from the respective purposes and is otherwise of economic nature. Wherever possible and appropriate, we process your data in pseudonymised or anonymised form.
- dd) Due to legal requirements (Art. 6(1) sentence 1 lit. c GDPR)
We are subject to various legal obligations, such as statutory retention and documentation obligations under commercial and tax law (e.g. under the German Commercial Code (HGB), German Criminal Code (StGB), or German Fiscal Code (AO)).
4. Processing of special categories of personal data (Art. 9 (2) lit. a) GDPR)
The processing of your special categories of personal data is carried out on the basis of your consent pursuant to Art. 9 (2) lit. a) GDPR. You may withdraw your consent at any time with effect for the future. We inform you that the withdrawal of consent shall not affect the lawfulness of processing carried out on the basis of the consent before its withdrawal.
5. Disclosure of data to third parties and processors
The disclosure of personal data also constitutes processing within the meaning of the foregoing Section 3. However, at this point we would like to inform you separately about the disclosure of data to third parties. The protection of your personal data is very important to us. For this reason, we are particularly careful when it comes to disclosing your data to third parties.
As a rule, your personal data is disclosed to third parties for the following purposes:
- processors with whom we have concluded an agreement pursuant to Art. 28 GDPR;
- shipping (e.g. shipping service providers);
- payment processing (e.g. payment service providers);
- accounting (e.g. tax advisors);
- legal disputes (e.g. lawyers);
- communication platforms (e.g. email, other messenger services);
Data processing takes place exclusively in a Member State of the European Union or in another state party to the Agreement on the European Economic Area. Any transfer to a third country shall only take place if the special requirements of Art. 44 et seq. GDPR are met.
6. Use of Artificial Intelligence
To optimise our processes and to fulfil the above-mentioned purposes, your personal data may be processed using artificial intelligence (AI) technologies. AI is used in particular to:
- carry out data analyses,
- generate forecasts, and
- make routine processes more efficient.
The AI used operates in accordance with the principles of the GDPR. Any decisions that have legal or similarly significant effects on you are not made solely by AI but are supplemented by human intervention.
7. Erasure
Your personal data will be erased by us insofar as it is no longer necessary for the purposes for which it was collected or otherwise processed, unless processing is required for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defence of legal claims.
8. Data subject rights
You have the right:
- pursuant to Art. 7 (3) GDPR, to withdraw at any time any consent you have given to us. This has the consequence that we may no longer continue the data processing that was based on that consent for the future;
- pursuant to Art. 15 GDPR, to request information about your personal data processed by us. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by us, and the existence of automated decision-making, including profiling, and, where applicable, meaningful information about its details;
- pursuant to Art. 16 GDPR, to request without undue delay the rectification of inaccurate personal data stored by us or the completion of your personal data;
- pursuant to Art. 17 GDPR, to request the erasure of your personal data stored by us, insofar as it is no longer necessary for the purposes for which it was collected or otherwise processed, unless processing is required for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest, or for the establishment, exercise, or defence of legal claims;
- pursuant to Art. 18 GDPR, to request restriction of processing of your personal data where you contest the accuracy of the data, the processing is unlawful but you oppose its erasure, we no longer need the data, but you require it for the establishment, exercise, or defence of legal claims, or you have objected to processing pursuant to Art. 21 GDPR;
- pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used, and machine-readable format or to request transmission to another controller; and
- pursuant to Art. 77 GDPR, to lodge a complaint with a supervisory authority. As a rule, you may contact the supervisory authority of your habitual residence or place of work for this purpose.
9. Right to object
Insofar as your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) sentence 1 lit. f) GDPR, you have the right, pursuant to Art. 21 GDPR, to object to the processing of your personal data on grounds relating to your particular situation.
